Well, we had a consultation with a lawyer today. We did some research on some potential lawyers over the weekend, made a choice and called them today and they managed to squeeze us in right away today. Very helpful!
They said that Stephan was lucky that he was given 90 days to restore his permit, and that others were simply told to leave the country. Basically, the summary is that the lawyers can help find out what's going on with the Labour-market-opinion (LMO) - which is what the company has to file and get approved to hire a foreign worker - and help if they have to re-do the LMO. The LMO requires a job-ad. Worst case scenario, they have to re-do the job ad (2-3 weeks it has to be out), and then send in the application (4 weeks). So about 7 weeks, 8 max. Best case scenario, the LMO already in process is acceptable and we get it in a few weeks.
Once we have the LMO, we don't even have to send in an application for a new work permit. Since we will have the LMO, we just need a job offer from the company, Stephan's resume and his credentials and drive over the border and back, and they can give him a work permit on the spot...no processing time!
So, best case scenario Stephan is back to work in 3-4 weeks.
Worst case scenario, he is back to work in 2 months! Max!
As long as we file for the new work permit before the 90 days are up, Stephan can stay. So things are looking up. Now we just have to get the ball rolling!
